Terms of service
Terms and Conditions
1. General Terms
This website, jerichoskincare.com.au (“Website”), is owned and operated by Olit Pty Ltd (ABN 48 630 248 458) (“Jericho Skincare”, “we”, “us” or “our”). Olit Pty Ltd is an authorised distributor of Jericho Cosmetics products in Australia and New Zealand.
By accessing, browsing or using this Website, creating a customer account, or placing an order through the Website, you agree to be bound by these Terms and Conditions, our Privacy Policy, Shipping Information, Returns Policy and any additional terms applying to a particular promotion or offer.
We may amend these Terms and Conditions at any time. Updated Terms and Conditions will take effect when published on the Website. Your continued use of the Website after an update constitutes acceptance of the revised Terms and Conditions.
Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded, restricted or modified under the Australian Consumer Law or any other applicable legislation.
2. Governing Law
These Terms and Conditions are governed by the laws of Australia and any applicable state or territory laws.
You submit to the jurisdiction of the courts and tribunals of Australia that have authority to hear any dispute relating to these Terms and Conditions, the Website or an order placed through the Website.
3. Product Information
We make reasonable efforts to ensure that product descriptions, photographs, ingredients, directions and other information displayed on the Website are accurate and current.
Product packaging, ingredients, colours, appearance and specifications may occasionally differ from the information or images displayed on the Website, including where a manufacturer changes a product formulation or packaging.
Information about product ingredients, directions and safety precautions is generally based on information provided by the relevant manufacturer.
Customers are responsible for reviewing the product information and ingredient list before purchasing or using a product. Customers should not use a product if they know or suspect that they are allergic or sensitive to any listed ingredient. Where appropriate, customers should perform a patch test before using a new skincare or cosmetic product.
Information provided on the Website is general information only and is not intended to replace medical advice. Customers should seek advice from a qualified healthcare professional regarding allergies, sensitivities, medical conditions or adverse reactions.
4. Pricing and Payment
Unless otherwise stated, all prices displayed on the Website are in Australian dollars and include 10% GST.
Prices, promotions, product availability and delivery charges may change at any time without prior notice.
We reserve the right to correct pricing, product-description, promotional or technical errors. If an error affects an order that has already been placed, we may contact the customer to provide the option of proceeding on the corrected terms or cancelling the affected item or order for a full refund.
Payment must be successfully authorised before an order is processed or dispatched.
5. Acceptance, Verification and Cancellation of Orders
Submitting an order through the Website does not guarantee that the order has been accepted. An order is subject to payment authorisation, product availability, fraud screening, address verification and our acceptance.
To the extent permitted by law, we reserve the right to accept, decline, hold, limit or cancel any order at our sole discretion, including after an order confirmation has been issued.
We may exercise this right where, for example:
- a product is unavailable;
- the price or product information contains an error;
- payment cannot be authorised or verified;
- the delivery address or contact details are incomplete or unclear;
- the order is identified as potentially fraudulent, unauthorised or unusually high-risk;
- the customer has previously initiated an improper or unresolved payment dispute or chargeback;
- the customer has failed to return goods after receiving a refund, replacement or exchange;
- there has been suspected misuse of our returns, refund, promotional or customer-service processes;
- accepting the order may expose us, our staff, another person or our business to unreasonable risk; or
- we reasonably consider cancellation appropriate for another lawful business reason.
To the extent permitted by law, we are not required to provide a detailed explanation for declining or cancelling an order.
Where we cancel an order before fulfilling it, any payment received for the cancelled products will be refunded to the original payment method, unless the payment has already been reversed, disputed or refunded through the customer’s bank or payment provider.
We will not be responsible for indirect loss arising solely from our lawful decision not to accept or fulfil an order.
6. Right to Refuse Future Service
To the extent permitted by law, we reserve the right to refuse future orders, restrict access to the Website, close or suspend a customer account, or discontinue further customer service where we reasonably believe that a customer has:
- engaged in fraudulent, abusive, threatening, dishonest or unlawful conduct;
- misused payment, chargeback, refund, replacement or return procedures;
- provided false, misleading or incomplete information;
- caused an unreasonable financial, operational or safety risk to the business;
- failed to comply with these Terms and Conditions; or
- failed to resolve an outstanding matter involving payment or unreturned goods.
A decision to refuse future transactions does not remove any rights or remedies that the customer may have in relation to a previous completed purchase under the Australian Consumer Law.
7. Chargebacks and Payment Disputes
Customers should contact us at sales@jerichoskincare.com.au before initiating a chargeback or payment dispute so that we have a reasonable opportunity to investigate and resolve the matter.
Where tracking information, delivery confirmation or other evidence shows that an order was dispatched and successfully delivered, and the customer later initiates a chargeback claiming that the order was unauthorised, not received or otherwise invalid, we may provide relevant order, payment, communication and delivery records to the bank, card issuer, payment provider, courier, insurer or relevant authority.
Where a chargeback is determined to be improper, fraudulent or inconsistent with the available delivery or transaction evidence, we may:
- decline future orders from the customer;
- suspend or permanently close the customer’s account;
- discontinue further discretionary customer service;
- request payment of any outstanding amount;
- recover reasonable costs associated with the dispute where legally permitted; and
- take any other lawful action available to us.
We may also refuse future service where a previous order was dispatched and confirmed as successfully delivered but was subsequently subject to a chargeback that caused us financial loss.
Nothing in this section prevents a customer from raising a genuine payment dispute or exercising a right available under the Australian Consumer Law or applicable payment-service rules.
8. Replacement Products and Unreturned Original Products
Where we agree to provide a replacement product on the condition that the original product is returned, the customer must follow the return instructions and return the original product within the timeframe communicated by us.
Unless otherwise agreed in writing, ownership of a replacement product does not transfer unconditionally where the replacement was supplied subject to return of the original product.
If we send a replacement product and the customer fails to return the original product as required, we may, to the extent permitted by law:
- request the immediate return of the original or replacement product;
- charge or invoice the customer for the additional product where the customer was clearly informed of this condition;
- suspend any further replacement, refund or discretionary support;
- refuse future orders and close or restrict the customer’s account; and
- take reasonable steps to recover the product, its value or related costs.
We may discontinue future service to a customer who retains both the original and replacement products without our written authorisation.
This section does not apply where the customer was not required to return the original product or where retaining or disposing of the product was authorised by us in writing.
9. Order Processing and Dispatch
Orders are generally processed and dispatched on business days, Monday to Friday, excluding public holidays.
We aim to process orders within 24 hours, but processing times are estimates only and may vary due to order volumes, payment verification, stock availability, public holidays or other circumstances.
Orders placed on Friday afternoons, weekends or public holidays will generally be processed on the next business day.
Dispatch confirmation does not guarantee delivery within a particular timeframe.
10. Delivery
We reserve the right to select the carrier and delivery method used to deliver an order to the customer’s nominated address.
We use Australia Post and other courier services. Once an order has been dispatched, we will generally send the customer a dispatch confirmation containing the carrier and tracking information.
Customers are responsible for:
- providing a complete and accurate delivery address;
- providing a valid telephone number and email address;
- monitoring tracking information;
- responding to reasonable requests from the carrier; and
- arranging collection or redelivery where required.
We may hold an order until we receive a complete and verifiable delivery address, telephone number or other information reasonably required to process or deliver the order.
If a delivery problem occurs, we will provide reasonable assistance. Customers may first be required to contact the assigned carrier using the tracking information provided.
Estimated Australia Post delivery times are generally:
- Standard Post: 1–7 business days; and
- Express Post: 1–3 business days.
These timeframes are estimates only. Delivery may take longer for regional or remote areas, during peak periods, due to weather events, carrier delays or circumstances outside our reasonable control.
Where an alternative courier is used, an estimated delivery date may be included in the dispatch confirmation.
Please refer to our Shipping Information for further details.
11. Authority to Leave
Customers may be offered the option to authorise a carrier to leave a parcel at the nominated premises without obtaining a signature.
Where the customer selects or provides an authority-to-leave instruction, the customer accepts the risks associated with the parcel being left unattended at the nominated location.
Subject to any rights that cannot be excluded under applicable law, we may be unable to accept a claim for theft, loss or damage occurring after the carrier has delivered the parcel in accordance with the customer’s authority-to-leave instructions.
12. Incorrect Addresses, Unclaimed Parcels and Redelivery
Customers must check their delivery details before submitting an order.
If an order is returned to us because the address was incorrect or incomplete, delivery was refused, or the parcel was not collected, we may require the customer to pay reasonable redelivery costs before sending the order again.
Where a refund is requested for a returned parcel, reasonable delivery and return-to-sender costs may be deducted from the refund where permitted by law and where the return was not caused by our error or a failure to comply with a consumer guarantee.
13. Returns, Refunds and Exchanges
Customers who wish to request a return, refund or exchange should contact our Customer Service team at sales@jerichoskincare.com.au.
Customers should contact us as soon as possible after receiving an order where:
- the wrong product or quantity was supplied;
- a product was damaged during delivery;
- a product appears to be faulty; or
- an item is missing from the order.
We offer change-of-mind returns within 10 days, subject to the eligibility requirements, exclusions and procedures set out in our Returns Policy.
Claims relating to damaged, faulty or incorrectly supplied products should be submitted within the periods specified in our Returns Policy. However, any stated reporting timeframe does not limit rights that cannot be excluded under the Australian Consumer Law.
Returned products must comply with the requirements of our Returns Policy unless the return relates to a remedy available under the Australian Consumer Law.
Refunds will generally be issued to the original payment method. We will not issue duplicate refunds where a payment has already been reversed or refunded through a chargeback, bank or payment provider.
Our Returns Policy forms part of these Terms and Conditions.
14. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
The customer may be entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. The customer may also be entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms and Conditions is intended to exclude, restrict or modify those rights.
15. Product Claims and Results
Product descriptions may include information and claims supplied by the relevant manufacturer.
Individual skincare and cosmetic results may vary depending on factors including skin type, age, application, frequency of use, sensitivities and other products used.
Except for representations expressly made by us and rights that cannot be excluded under applicable law, we do not guarantee that a product will produce a particular cosmetic or skincare result for every customer.
16. Special Offers, Promotions and Discount Codes
Promotions, discount codes, gifts with purchase and special offers may be subject to separate terms, eligibility requirements, minimum-spend requirements, exclusions, start and end dates, and stock availability.
Discount codes must be entered correctly at checkout and cannot generally be applied after an order has been submitted.
Unless otherwise stated:
- only one discount code may be used per order;
- offers cannot be exchanged for cash;
- promotional products and gifts are available while stocks last;
- promotions cannot be combined; and
- we may cancel, modify or withdraw a promotion where reasonably necessary.
Any promotion-specific terms form part of these Terms and Conditions.
17. Website Use
Customers must not use the Website:
- for an unlawful or fraudulent purpose;
- to interfere with the security or operation of the Website;
- to submit false, misleading or unauthorised information;
- to impersonate another person;
- to place orders using payment details without authorisation;
- to reproduce Website content without permission; or
- in any manner that may damage our business, systems, reputation, customers or service providers.
We may restrict or terminate Website access where we reasonably believe that these requirements have been breached.
18. Privacy
Personal information is collected, stored, used and disclosed in accordance with our Privacy Policy and applicable privacy legislation.
Information may also be disclosed to payment processors, fraud-prevention providers, delivery carriers, banks, insurers and relevant authorities where reasonably necessary to process an order, investigate suspected fraud, respond to a chargeback or comply with a legal obligation.
19. Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision will be read down or removed to the minimum extent necessary. The remaining provisions will continue to operate.
